In 2005, as part of our divorce agreement, my ex and I decided to keep the same auto insurance but under separate policies. We had been with this company for years. My policy was on auto pay meaning that the payments were taken directly from my account. He walked in to pay his. About 6 months after the divorce, I was pulled over for a routine traffic stop and was told I was driving an uninsured vehicle. Without insurance, my registration was also invalid. Both tickets totaled 1K. My car was taken into impound. I checked and found the officer was correct. On good terms with my ex, I told him what happened. He said for the past 6 months, each time he went in to make a payment, the girl HIS was already paid. Realizing what had happened. They were applying my payments to his automobile. I was furious. I notified the agent who initially did not want to accept blame, but since the payments were automatic and my account number was on each payment they took, they were responsible. The error was compounded by the fact that the cancellation notice went to HIS address (how dumb was that!) So I had no way of knowing that I was cancelled. I was without a car for 2 weeks and lost my job. After much haggling and many sleepless nights of wondering what to do without a job or a car, the insurance company finally admitted blame, paid the impound fees of $1,250.00. The agent also said they would handle the 2 tickets totaling 1K. FAST FORWARD TO 2010 in my state, the county did a scofflaw sweep and I was summoned to court with over 5 thousand other delinquent drivers to address unpaid tickets. The order was come to court by April 30th or be arrested. Realizing this had to be a mistake, but fearful of the law, I stood in line for over 5 hours in blazing heat, then sat in court another 5 hours waiting for my day in court. I was immediately threatened with arrest because the 2 tickets were not paid. Up to that moment, I had no idea the insurance company had not paid the 2 tickets. This time, not only was my insurance and registration cancelled, my license was suspended due to the age of the infraction (5 years). In front of the judge, I called the agents' office only to be told by the secretary that they had no intention to pay the ticket. Paying to get the car out of impound was enough. When the judge heard this she was shocked and let me off with a promise to pay in 5 days. She made me promise not to drive. With no way to get home but drive, I took a chance, and was pulled over. The officer informed me that due to the vast number of outstanding cases, tags bearing our county name would be targeted for a while (talk about a police state!). I showed him my documents from the court and headed home. This is a nightmare. Would I have a case if I filed suit against my insurance company for failing in their fiduciary responsibility to a 16 year client in good standing? By the way this company is one of the largest in the country.

I'm a childhood bone cancer survivor. I had osteosarcoma back in 1992 and had my leg amputated but the cancer never returned and the only issue after is I can't donate blood. I'm Canadian living in the province of Newfoundland. and while Canadian's have most of their health care covered though taxes most medications, private rooms, ambulance services, dental, and other services are not covered by all provinces. Hi all, I was hoping that I could get some guidance as to how I should proceed with this. Thank you in advance. The accident occurred 7 days ago in CA. I was driving home from work in the 4th lane of a 4 lane highway. There was a gap of approximately 4~5 cars in the 3rd lane, so I switched into that lane. By the time I finished the lane change, there was approximately 3~4 cars distance between me and the car behind me. I then drove for approximately a 100 yards, at which point the traffic suddenly slowed and I decelerated. The guy behind me, however, seems to have been looking elsewhere and rear ended me. However, before he collided, he managed to swerve his car and hit the corner of my rear bumper with the corner of his front bumper. We pulled over to the side of the road and exchanged information. It turns out that he does not have a driver's license (or any California/U.S. ID; he showed me a Mexican ID). He begged me not to call the police, admitted fault and said that he would settle it through his insurance (he is insured with a VERY shady place called Access General). I took pity on him, especially since it was very likely that he is an illegal immigrant, so I just took his information down and moved along. Fast forward a few days, and I find out that he has told his insurance that I cut in front of him and that he is not at fault. Since there are no witnesses or a police report, his insurance takes his side. Meanwhile, since I only have liability with Geico, they are saying that they can't help me. The damage to my car is between $4~5k, and that is not even taking into account devaluation of the car's value. I feel very cheated because I took pity on him and I am rewarded with a repair bill that nobody wants to deal with. I have called him multiple times and asked him to tell the truth, but he just ignores me. I am now very angry and want to do 2 things: 1. Get my car repaired. 2. Screw up his life. Hopefully get him deported (very strong liklihood of him being an illegal immigrant), or at the least bankrupt him. I took pity on him because he was in a time of need. All he had to do was tell the truth to his insurance, but he was afraid that his monthly bill would go up... so he lies and screws me instead. Hello, I would really appreciate any one who can help me out with this, personally i am so disgusted with the government and the way the country is run that i don't know much about politics as i stay away from it for my own stress levels. Two months ago my nephew took his own life, as well as a variety of mental health problems (Which of course also go's uncared for in this country) other reasons he couldn't cope to live in society was that he couldn't get a job (200+ job application attempts) he discovered that to increase his chance of getting a job he would learn to drive so he can get to A to B. After going into approx. 90% of his life savings he managed to take driving lessons and even managed to pass his test. At this point he couldn't get insured because he discovered even if he was in a FULL TIME job he couldn't afford it. Yes he was male and was an adolescent. But he didn't want to drive to show off , have a nice car . Etc. he wanted a car to get to A to B to increase the chances of getting a job. I want to know who is in charge of car insurance etc. (department of transport??) so i can write to them and explain the situation which makes me sick to my stomach thinking about. Everyones aware the government are trying to get young drivers off the road, but to then expect them to find a job even in this tough climate is beyond me. After the accident, my adjuster originally estimated the damage to be around 3,400 dollars. With my 500 dollar deductible, they sent me a check of 2,900 dollars. But at the body shop, they estimated the cost of damage to be around 7,700 dollars so now the body shop called over an appraiser to look over the car again. Since the body shop's estimate is a lot higher, would the insurance company issue me a new check with the higher amount to cover for the damage? Is that what a supplement is? And what do I do with the 2,900 dollar check? Do I send it back and or have it voided and get a new check with the higher amount?

I totaled my month old car with only liability insurance, do I still HAVE to pay off the car?

i just got a '01 explorer from a dealer less than a month ago, two days ago i rolled it, now its totaled. i only have LIABILITY insurance, and the insurance company said i have to pay off the rest of the car, which i expected, but when i called the dealer she said she might be able to count the car as a total loss, and get me in another car from them, without paying for the old one anymore. she is going to let me know in a couple days if they can. is this possible to just somehow avoid all the payments on the old car and start over new? are they scared i would end up not paying them for a car i dont have, so they somehow write it off and start a new payment plan on a whole new car? I'm a US citizen studying in Canada. Sunday, I fractured my wrist playing football. I saw a sports medicine doctor on Monday, who sent me for x-rays and informed me I had a fracture. He told me to go to the hospital to get a proper cast. The fracture clinic there had closed for the day so I went to the ER, where they wrapped me up and took another x-ray. I saw an orthopedic specialist this morning who set my fracture (ideally I should have come in immediately after the incident and had it set then), after which they took another set of x-rays to check if the setting worked. The prognosis is good. I didn't pay a cent in all this, as I'm covered under the University Health Insurance Plan, which all international students in Ontario get, as the Ontario Health Insurance Plan only covers residents, anything under OHIP is covered with UHIP. I'm curious, what would the cost have been had this happened in the US, with and without insurance? Thank You
